Former U.S. Attorney General Alberto Gonzales, who served under President George W. Bush, told the Huffington Post that Trump's actions "presents a challenge that the Department of Justice will have to deal with".

Conway believes that while Trump's tweets on the ban may appeal to his voter base, it isn't the right decision in terms of garnering the right number of votes to win a case in the Supreme Court.

"In any event we are EXTREME VETTING people coming into the U.S.in order to help keep our country safe".

Asked Monday whether the Trump team was concerned about the tweets tainting the case, Deputy Press Secretary Sarah Huckabee Sanders said "not at all". As a candidate, Trump called for a "Muslim ban", comments that came back to haunt him as president when the courts determined that even his scaled-down order was "rooted in religious animus and meant to bar Muslims from this country".

James Grimmelmann, a law professor at Cornell Law and Cornell Tech, said in an email that Trump's tweets can be used "just like anything else he says or does" - as long as the courts take into account the nuances of the format.

Sixteen states filed briefs with the Supreme Court on Monday asking that President Donald Trump's travel ban policy be reinstated, saying his executive order was "emphatically not a 'Muslim ban'". The words "travel ban" do not appear in the filing, and the only time the Justice Department uses the phrase "Muslim ban" is to say the executive order was not one.

White House adviser Kellyanne Conway's husband said on Twitter that Trump's comments won't help the U.S. Justice Department defend the order as the court determines whether it complies with the U.S. Constitution. "Every sensible lawyer in [the White House Counsel's office] and every political appointee at DOJ [would] agree with me (as some have already told me)".

In the fourth tweet, he pointed out that despite court orders forbidding the government to implement the travel ban, his administration was taking the measures necessary steps to prevent unwanted people from entering the United States.

Trump has the authority to order the Justice Department to pursue a different strategy. The Justice Department declined to comment.

Opponents of the travel order, on the other hand, took pleasure in Trump's self-inflicted wound. We need the courts to give us back our rights.

The poll also finds that half of Americans (50%) favor the measure which would temporarily halt travel to the USA from Syria, Iran, Libya, Somalia, Sudan, and Yemen, countries known to have ties to terrorism. Should the court decide to stay the current injunction while it considers the case, however, a formal ruling on the order could be purely academic.
